A Wyoming mother who allegedly gunned down her 11-month-old son instead of ceding custody to his biological father is asking to be freed.

Madeline Daly, 35, is accused of first-degree murder after a month-long custody battle ended in the murder of her son, Basil Stoner, just two days before Christmas.

Daly allegedly kidnapped the boy back in November and fled to New Mexico, defying a court order granting custody to his father, Jake Stoner.

Police were attempting to serve the mother with a felony kidnapping warrant when she rushed the boy into an RV, cops said.

Trying to reach Daly, police eventually spoke with her by phone after she refused to leave the van.

A SWAT team was dispatched after authorities learned she might be armed, and shots were fired before they could intervene, per the release.

Authorities said they found the 35-year-old inside the RV with a gun pointed at her head and Basil on the floor with a gunshot wound.

Responders fought to save the 11-month-old, but he died before he could be airlifted to the hospital.

Daly was arrested and thrown behind bars at the Grant County Detention Center, where she remains held without bail.

The 35-year-old's attorney made a bombshell push for her release from jail, but District Attorney Mark Abramson refused, citing the ‘outrageous circumstances,' per Cowboy State Daily.

'A mother absconded with her child from Wyoming, traveled around, we're not sure where, but ended up here being confronted by law enforcement and chose to murder her child, her own child, with a nine millimeter gun to the face,' Abramson said, per the outlet.

'We are concerned that not only is the case strong, but the likelihood that this defendant would abscond again and would find herself outside of the jurisdiction of Grant County or New Mexico is just too great.'

Abramson said the mother's crime is 'as personal as you can get.'

'There are just too many red flags in this case, and there are no circumstances that would justify release of this defendant into our community.'

The judge slammed the request, citing safety concerns for Daly and those around her. 

He pointed to Daly’s chilling statement—‘Jake can’t get Basil’—as evidence of her alleged intent to harm her son and defy the Stoners, warning that the family could be in danger if she were released.
