A Florida man allegedly killed his neighbor after a fight over loud music.
Tony Deuser has been charged with second-degree murder, according to a press release from the Hernando County Sheriff’s Office, and is being held without bond at the Hernando County Detention Center.
Deuser will plead not guilty, defense attorney Jimmy Brown told Oxygen.com.
On April 7, deputies responded to a report that Francis Biegaj, 52, was bleeding from a gunshot wound in the arm, per the press release. He later died from his injuries.
A witness told investigators they heard multiple gunshots, then saw a man—later identified as Deuser—walking away from a home holding what appeared to be a pistol.
After SWAT and crisis response teams surrounded his home, authorities eventually coaxed Deuser out, according to the release, and he was taken into custody.
Surveillance video showed the moments leading up to the shooting, with Deuser in Biegaj’s driveway while loud music came from an ATV, according to an affidavit for a search warrant obtained by Oxygen.com.
In the footage, Biegaj approached Deuser saying, “Get the f--k outta my yard.” Deuser then reached into his pants pocket and shot Biegaj.
Biegaj fled into his garage, per the warrant affidavit, but Deuser continued to fire in his direction before heading back home.
According to the warrant affidavit, Biegaj’s wife said her husband came inside calling her name before collapsing. She called 911 and attempted CPR.
Deuser later told investigators that Biegaj had been playing loud music for years, and that he brought a gun as a scare tactic because he didn’t think Biegaj would turn off the music, according to the warrant affidavit. When Biegaj refused to turn it off, said Deuser, he shot him and went home.
When police informed Deuser that Biegaj died, he said, per the warrant affidavit, “Well, that sucks.”
Deuser will next appear in court on June 2. He is facing a life sentence with no possibility of parole, his attorney told Oxygen.com.
